RETAILER REGULATIONS
These rules apply and must be used in conjunction the contract application. All potential retailers, as well those who have received a contract from Wyoming Lottery Corporation, will be subject to these rules. The Lottery will enforce these rules and the retailer contract.
Definitions
"Age-controlled zone" is an area in which a natural person under 21 years old is not permitted to enter or remain, as determined by the Wyoming Liquor Commission.
An "Agent" can be defined as a corporate officer (fraternal director), franchisee, or any other person who makes decisions about retailer business.
Applicant is a business owner that applies to the Lottery for a contract for selling Lottery tickets.
"Application" is the information, forms, and documents that an applicant must submit to the Lottery to request a contract as a retailer.
"Background Investigation" and/or "Background Check" are the processes of looking up and compiling criminal, financial and commercial records for an individual or organization.
"CEO" refers to the Chief Executive Officer at Wyoming Lottery Corporation.
"Chain Account", means:
Wyoming may have more than one location that is controlled and managed by a corporation.
Wyoming is home to more than five locations. Franchisees can operate each location.
"Complete application" is an application that has been completed completely. The applicant must sign the application when requested.
Dishonesty is a crime that involves fraud and deceit. It includes, but it is not limited, embezzlement and misappropriation or misuse of funds, fraud. Perjury, false swearing, perjury. Theft by deception, theft services, or obtaining cash under false pretenses.
"Drawing" refers to the formal selection of winning numbers, which determines the number of winners for each level of a prize game.
Franchisee is a retailer granted a franchise in order to sell a company's products (Chain Store) and services in a particular area.
"Immediate family" or "family member" can refer to a natural person’s spouse, child or brother, or sister, or parent-by-blood or adoption.
The term "Key Person" refers to any owner, executive, agent, or other person whose position might affect or could affect the fairness and security, integrity, honesty, and integrity of the Wyoming Lottery operations.
"Lottery," means Wyoming Lottery Corporation.
"Lottery contract” means any contract the Lottery enters in for the purchase or lease of goods or services.
"Lottery Game" is any variation of an approved Lottery draw game (i.e. Powerball(r), Mega Millions()):
"Lottery games retailer" or "retailer", means an entity or person authorized by the Lottery in order to sell lottery tickets.
"Lottery Headquarters" can be identified as the Wyoming Lottery Corporation at 1620 Central Avenue Ste. 100, Cheyenne WY 82001.
"Lottery Sales Location" is the area where Lottery Products are sold.
"Lottery terminal" refers to a device that generates Lottery ticket for sale.
"Mega Millions" will refer to the games listed in Wyoming Lottery Rule.
"Minimum sales" - The Lottery will set minimum sales thresholds that are based on geography and population as well as sales averages and foot traffic.
Multi-State retail chain" refers to any retailer (including an applicant) who:
Five to five retail locations located in Wyoming. There may also be one or more outside of Wyoming.
Shares ownership and control of each location
"MUSL", shall refer to the Multi-State Lottery Association.
The "MUSL Product Group" shall refer to any group of lotteries that has joined together in order to offer an online product according to the Multi-State Lottery Agreement.
"Performance Bond", shall refer to a bond which guarantees the faithful performance of the Lottery Retailer.
"Personal disclosure" is information and documents that relate to the personal, criminal, or financial history of a natural person, as well as their associations with others.
Powerball refers to the games listed in the Wyoming Lottery Rule.
"Prize" refers to any award or monetary amount that can be given to Lottery players for valid claims on winning Lottery tickets or shares.
"Premises" is the place where shares and traditional Lottery tickets are sold.
Promotions can refer to contests, events, and other mechanisms Lottery may offer, or that Lottery authorizes retailers, to offer. You may be able to benefit from certain promotions, such as receiving an additional benefit beyond a prize or lotto game.
The lottery may refer to any remedy as a solution to the retailer's contractual or financial problems.
"Retailer agreement" is a contract between the Lottery, a retailer, and the Lottery for the authorized purpose selling Lottery tickets and shares to the public.
"Game Ticket" (or "Ticket") is a ticket that is produced by a terminal. It contains the game caption and one or more lettered play plays, as well as the drawing date, the ticket's price, the retailer number and a serial numbers that are compatible with the Lottery central computer system.
"Traditional Lottery" refers to the following lottery games that are offered by Wyoming Lottery Corporation.
Mega Millions
Powerball;
Any other Lottery games that are not designated by Wyoming Lottery Corporation but approved by Wyoming Lottery Board of Directors.
Unclaimed prize is any prize that was offered in a Lottery lottery game but has not been submitted to it for validation and payment. It also includes any ticket or share that was sold or distributed to members of the public.
"Website" is the Lottery’s Internet address at http://www.wyolotto.com. It also includes any other website that might be used by the Lottery to promote a specific promotion or program.
"Winner claim Form" is a form that is provided by the Lottery to a player or retailer of Lottery for the purpose claiming a prize.
General Application Requirements
General Information: The Lottery Board of Directors may promulgate, adopt, amend, or repeal retailer rules and procedures after the Lottery director has determined that such rule/procedure promulgation/adoption, amendment, or repeal is in best interest of Lottery.
General: Any person who is a business person or a responsible individual within a company may submit a request.
Compliance required: All applicants must complete a full application. The applicant must complete a personal and business disclosure. This application must also include but not limit to:
Authorization (consent of the applicant) for the investigation of the applicant
Disclosure of source of funds, financing, and business income used in the purchase and operation the applicant's business.
Premises ownership. If the premises do not belong to the applicant, they must be furnished to the Lottery.
A statement of the address and name of the owner of such premises.
Any document required by the Lottery to show that the applicant is eligible for possession of the premises
Any information that the lottery requests pertaining to other interest
Additional information requested by the Lottery
Retailer Information
Wyoming must have a retail location. Lottery retailers will only be allowed to contract with authorized people. Any Wyoming-based retail establishment may apply to receive a Certificate of Authority for the sale of lottery tickets. All retail locations must not be situated within the borders of Indian reservations or federal parks. To obtain a contract as Lottery Retailer, you must first submit an application to the Lottery. The application form is used to gather sufficient information to enable the Lottery's to start all required checks.
All information is disclosed. The Retailer application does not include the applicant's name or the location of the business. The Wyoming Secretary Of State and other sources will verify all information submitted on the application.
Eligibility for a contract: Retailers will need to undergo an investigation into their criminal history, financial background, and financial accountability. The Department of Criminal Investigations will conduct a fingerprint test on retailers. Before a retail store can be designated as a Lottery retailer, it will consider the following:
The retailer's financial responsibility
The retailer's business;
Accessibility of the business location to the public by the retailer, compliance with the Americans With Disabilities Act
The operation's security and efficiency
Public convenience can be served by existing retailers efficiently if they are able to meet the following criteria:
Representation géographique
Customer Count
Hours of operation/days open
Potential for Lottery Sales (Projections)
Lottery will verify the payment of taxes, interest, and penalties to the local or state government, as well as the ability of the company to support the lottery ticket sales.
It will not be permitted for retailers to sell only lottery products. A business that already sells lottery products can also be sold.
Lottery reserves right to conduct background investigations of any lottery retailer in order preserve the integrity and security of the Lottery.
